Florida Governor Ron DeSantis has signed legislation aimed at cracking down on sales of unauthorized e-cigarettes that the state considers appealing to children.
The new law (HB 1007) targets only disposable e-cigarette products that are not authorized by the U.S. Food and Drug Administration. The rule will take effect on October 1.
According to media reports, the bill in its original form would have banned the sale of any e-cigarette product that had not received FDA approval.
The law now directs the state Department of Legal Affairs to create and maintain a product directory listing all disposable e-cigarettes it considers attractive to minors. The department must publish the list by January 1, 2025, and update it regularly.
Once a product is added to the list, retailers and wholesalers in Florida have 60 days to sell through or remove that product from inventory. Any products that remain in circulation will be seized and destroyed.
Starting March 1, 2025, manufacturers selling prohibited products in the state will face fines of $1,000 per day for each such product until it is removed from the market. This restriction also applies to retailers, wholesalers, and distributors shipping products into Florida.
Anyone convicted for a third or subsequent sale of a nicotine product, including e-cigarettes, to a person under 21 will face a third-degree felony charge, punishable by a fine of up to $5,000 and five years in prison.
