Hong Kong Secretary for Labour and Welfare Chris Sun said that as the government gradually implements a full smoking ban at all construction and building maintenance sites, contractors and subcontractors could face legal action if workers are found smoking at construction or building repair sites. Sun noted that employers will bear legal responsibility unless they can prove they have fulfilled their duty to prevent smoking on-site.

The proposed smoking ban was introduced after a fatal fire in Hong Kong last November and is expected to be implemented through amendments to subsidiary legislation, which will be submitted to the Legislative Council for review early next month. If approved, employers who violate the ban could face fines of up to HK$400,000 (about US$52,000). Sun said employers may be exempt if they can demonstrate that adequate preventive measures were taken, such as posting clear no-smoking signs, providing designated cigarette butt disposal points, and installing CCTV monitoring. However, he also warned that failure to adopt such measures could itself constitute grounds for prosecution.
