Mexico is moving toward taking a clear position on e-cigarettes and vaporizers, as lawmakers prepare to determine whether the industry will be regulated or banned. A recent constitutional reform backed by most major political parties would criminalize the production, distribution, and sale of e-cigarettes, vaporizers, and unauthorized toxic substances. Movimiento Ciudadano was the only party to oppose the measure.
 
 
The reform amends Articles 4 and 5 of the Constitution and places e-cigarettes alongside fentanyl abuse, which critics say reflects a global prohibitionist approach rather than policy based on domestic evidence. Secondary legislation under the General Health Law will determine the specific scope of the ban or regulatory framework.
 
Public health experts and advocacy groups, including the World Vapers’ Alliance, argue that sensible regulation could reduce illicit trade, protect adult consumers, and generate substantial tax revenue—estimated at as much as 6.94 billion Mexican pesos (US$374.8 million) per year.
 
The debate also highlights the potential of vaping technology in medical applications, such as inhaled drug delivery for conditions including asthma, migraines, and pain management, although challenges remain in regulation and consumer acceptance.
