US court rejects Logic request, does not block menthol e-cigarette ban

A U.S. court has rejected the request from e-cigarette brand Logic Technology Development, which sought to block the U.S. Food and Drug Administration (FDA) from enforcing a market denial order (MDO) against Logic's menthol-flavored e-cigarette products.

According to a recent report by Law360, the U.S. court dismissed Logic Technology Development's request, which aimed to prevent the FDA from enforcing the MDO against Logic's menthol-flavored e-cigarette products. 

It is reported that Japan Tobacco International (JTI) reached an acquisition agreement with Logic in 2015, bringing the Logic brand into its group business. Previously, Logic submitted a petition for review to the U.S. Third Circuit Court of Appeals, alleging that the FDA's rejection of Logic's premarket tobacco product application for its menthol-flavored e-cigarette products violated the Administrative Procedure Act. The court dismissed the request after concluding that the FDA's decision was based on scientific judgment. 

Logic claims that the FDA's application of the same regulatory framework to menthol as it does to fruit and dessert-flavored e-cigarettes is arbitrary and capricious. This is also the FDA's first MDO targeting menthol e-cigarette products.
