Biden administration backs FDA regulation of flavored cigars and menthol cigarettes, supports nicoti
The Biden administration recently announced its opposition to a bill introduced by House Republicans that would limit the Food and Drug Administration's (FDA) regulatory authority over flavored cigars and menthol cigarettes.
The FDA had previously stated that it would propose final rules this fall to ban flavored cigars and menthol cigarettes. However, a funding bill proposed by the House Appropriations Committee in May included provisions to prevent the FDA from banning flavored cigars and menthol cigarettes and to limit nicotine content in products.
Last week, the Biden administration released a policy statement opposing several provisions in the bill, including those regarding flavored cigars and menthol cigarettes. The statement indicated that these provisions would hinder the FDA's ability to protect youth from the harms of tobacco products.
It is clear that the Biden administration's stance indicates that, despite challenges to the FDA's authority to regulate tobacco products, the likelihood and final form of the bill passing remain uncertain. However, the Biden administration's position clearly supports the FDA's efforts to strengthen tobacco regulation.
