US Congress Bans Vape Mail; Small Retailers May Be Forced Out

The U.S. Congress has banned the U.S. Postal Service from shipping packages containing e-cigarettes.<\/span><\/div>

“Large, well-capitalized manufacturers will be prepared to pay the costs of complying with the new, more burdensome policies, while smaller manufacturers and retailers may not meet the requirements and will be forced out of the market.”<\/span><\/div>

According to the Winston-Salem Journal, the COVID-19 relief bill passed by Congress on December 21 prohibits the U.S. Postal Service from shipping packages containing e-cigarettes.<\/span><\/div>

The bill also requires e-cigarettes to comply with other rules currently governing online cigarette sales. Among other things, online retailers will be required to use private shipping services, collect adult signatures upon delivery, collect all applicable local and state taxes, and send a list of all transactions with state customers to the tax administrator of each taxing state.<\/span><\/div>

Critics say this legislation will impose significant burdens on vaping companies.<\/span><\/div>

FiscalNote analyst Stefanie Miller stated: “We believe this policy primarily drives the trend we are already seeing in the market, where large, well-capitalized manufacturers will be prepared to pay the costs of complying with the new, more burdensome policies.”<\/span><\/div>

“Meanwhile, smaller manufacturers and retailers may not meet the requirements and will be forced out of the market.”<\/span><\/div>
 <\/div>
“If the increased shipping costs are not enough, this bill will also impose a huge paperwork burden on small retailers, supported by the threat of imprisonment for even innocent mistakes.”<\/span><\/div>
