Lawmakers in Some U.S. States Urge FDA to Release PMTA List

Illinois Senator Dick Durbin has requested the U.S. Food and Drug Administration (FDA) to release a comprehensive and detailed list of applications that have been reviewed, approved, or are pending approval.<\/span><\/div>

The National Association of Convenience Stores (NACS) urged the FDA to publish the PMTA list, after the agency stated it would increase transparency for current applications.<\/span><\/div>

The Food Industry Association, the National Association of Truck Stop Operators, the American Petroleum Institute, and the National Association of Independent Gasoline Marketers signed a letter with NACS requesting the FDA to maintain transparency.<\/span><\/div>

NACS and the Retail Association stated in their letter: "The PMTA list is crucial for supporting compliance across the entire tobacco trade channel, helping to inform distributors, wholesalers, and retailers about which ENDS products are legally sold in accordance with FDA compliance policies." NACS added: "In this regard, such a list will also assist in enforcing mandatory sanctions against manufacturers who continue to introduce illegally sold products without pre-market authorization, or against those manufacturers who fail to submit PMTAs for products currently sold before the deadline."<\/span><\/div>

Mitch Zeller, director of the FDA's Center for Tobacco Products, confirmed in September that all PMTAs will be provided in a database format.<\/span><\/div>

Durbin is among those recently pressuring the FDA on this matter, including ongoing lobbying from industry associations, industry representatives, and store owners.<\/span><\/div>

"To protect public health and fulfill the obligation to enforce against non-compliant products on the market, I urge the FDA to immediately release a comprehensive product list of all relevant electronic cigarette applications received by the FDA," Durbin wrote.<\/span><\/div>
 <\/div>
"While I appreciate the large number of applications submitted to the FDA, and the agency intends to prioritize the review of products with the largest market share and public health impact, we know from recent years that young people will change their vaping habits based on the products available to them."<\/span><\/div>
