Trump Proposes Ending FDA Oversight of E-Cigarettes
Trump’s budget proposal called for a new agency under HHS to regulate tobacco products, including e-cigarettes, a move that could reshape or reduce the FDA’s role in vaping oversight.
Trump called last Monday for the establishment of a new agency under the Department of Health and Human Services to regulate tobacco products, including e-cigarettes. Before making this proposal, lawmakers seemed to have little interest in making such a change, but in 2019, Joe Grogan, the head of Trump's Domestic Policy Council, did express that he believed tobacco regulation by the FDA was meaningless.
Trump called for the establishment of a new agency under the Department of Health and Human Services to regulate tobacco products, including e-cigarettes.
“FDA-regulated drugs help people... it regulates devices that help people. Tobacco has no redeeming qualities,” Grogan said last November. Meanwhile, the budget request noted that this change would allow the FDA commissioner to “focus on the traditional mission of ensuring the safety of the nation’s food and medical supply.”
According to the proposal, the commissioner leading the proposed tobacco regulatory agency would be a person like the FDA commissioner, who must be confirmed by the Senate, “to increase direct accountability and respond more effectively to this critical public health issue.” Currently, the tobacco regulatory head is the head of the Center for Tobacco Products, and since this is an FDA division, the supervisory position does not require Senate confirmation.
FDA Criticism
Since the announcement of the nationwide flavor ban last month, the FDA has faced continuous criticism from both the e-cigarette industry and anti-e-cigarette advocates.
The ban applies to all flavors of pods and nicotine sticks except for tobacco and menthol, and the fact that e-liquid is not included has greatly angered anti-smoking advocates, who claim this will only lead young people to switch products. On the other hand, the e-cigarette industry has pointed out that banning flavors is not the solution, as smokers are trying to use these devices to quit smoking.
