Lost Mary Sues Lady Mary in the UK, Seeking Cancellation of Its Trademark

Hong Kong-based iMiracle (iMiracle) and Green Fun Alliance Ltd. filed a new publicly disclosed lawsuit in the High Court on December 21, claiming that Synergy Project Management LLC should lose its rights to the name "Lady Mary" in the e-cigarette and tobacco market due to its failure to use the trademark to guarantee the origin identity of its products. iMiracle did not provide further details in the lawsuit.
The company previously went to court to protect its Lost Mary e-cigarettes and ELFBAR products, which began sales in 2022.
In July, iMiracle sued a UK competitor selling e-cigarettes named Found Mary, claiming it was identical to its products.
iMiracle has also filed dozens of claims related to its ELFBAR products in the US, accusing at least 13 companies of selling counterfeit products with forged trademarks in Florida courts. In a broad trademark infringement war with at least a dozen similar retailers, Smoke Spot FL LLC and iMiracle reached a settlement after filing a joint motion to dismiss in September.
The ownership dispute over the Elf name between iMiracle and US e-cigarette company VPR Brands is still ongoing.
In October, VPR Brands sued Georgia-based tobacco store chain Vape Loft, partly to stop the retailer from selling ELFBAR products produced by iMiracle. VPR Brands pointed out that a federal judge in Florida had issued a preliminary injunction prohibiting the Chinese company from selling ELFBAR branded goods.
However, iMiracle is embroiled in litigation. These two Chinese companies and Vape Loft have countersued VPR Brands, claiming that the company is selling counterfeit products.
