US FDA and Customs Seize $18 Million Worth of Smuggled E-Cigarettes

The U.S. Food and Drug Administration (FDA) and U.S. Customs and Border Protection (CBP) announced that they have seized approximately 1.4 million unauthorized e-cigarette products, including controversial brands like Elf Bar.

The estimated value of these seized products exceeds $18 million. This impressive seizure occurred during a three-day joint operation, during which 41 batches containing prohibited e-cigarettes were discovered and confiscated.

FDA Commissioner Robert Califf stated, "The FDA is committed to continuing to prevent illegal e-cigarettes from entering the United States. Unscrupulous companies are doing everything they can to bring unauthorized tobacco products that appeal to youth into our country. The FDA will remain vigilant and work with our federal partners to prevent these imports from reaching our nation's youth."

The FDA and CBP conducted a joint operation at a cargo inspection station at Los Angeles International Airport, where teams inspected incoming goods for potential violations.

In preparation for this three-day operation, the teams spent months reviewing shipping invoices, identifying potentially illegal imported goods, and completing other investigative work, ultimately leading to the success of the operation, according to an FDA press release.

Once these goods are seized by the government, they will be handled according to the law; in the case of unauthorized new tobacco products, this usually means they will be destroyed.

CBP Acting Commissioner Troy A. Miller stated, "This enforcement action is a clear example of CBP's commitment to protecting the safety of our communities by blocking illegal goods from entering our country. With the rise of illegal e-commerce, our agency must remain vigilant in intercepting goods that pose serious risks to public health, including to youth, while disrupting the supply chains that bring them to our borders."

During the inspection of the goods, all items originated from China, and the team discovered various brands of illegal flavored disposable e-cigarettes.


In addition to Elf Bar, the seized e-cigarettes included EB Create products; earlier this year, the manufacturer of Elf Bar began selling the product under the names "EB Design" and "EB Create."

Other seized brands included Lost Mary, Funky Republic, RELX Pod, and IPLAY Max, among others. To evade tariffs and inspections, many of these unauthorized e-cigarettes were deliberately misdeclared as various items, such as toys or shoes, and were labeled with incorrect values.

Brian King, Director of the FDA's Center for Tobacco Products (CTP), stated, "Those who shamelessly attempt to smuggle illegal e-cigarettes into the country, especially products that appeal to youth, should take note of today's announcement. Federal agencies are aware of their tactics and will not hesitate to take action. The significant value of these seized products also serves as a reminder to these wrongdoers that their time and money are better spent complying with the law."

The FDA employs a comprehensive approach to compliance and enforcement of tobacco products, taking action against parties in the supply chain that violate the law, including manufacturers, importers, distributors, and retailers, as described in today's announcement.

The FDA also regularly addresses the issue of illegal e-cigarette imports by placing certain companies on the FDA's import alert red list, allowing the FDA to intercept products upon import without a full inspection, according to the press release.

For example, in May of this year, the FDA placed certain companies associated with unauthorized youth-appealing e-cigarettes on the red list, including companies related to the Elf Bar brand.
