On October 16, Smoore International (06969.HK), listed on the Hong Kong Stock Exchange, announced that the U.S. Food and Drug Administration (FDA) issued marketing denial orders (MDOs) to R.J. Reynolds Vapor Company (RJR) for six menthol-flavored and mixed berry-flavored e-cigarette products under the Vuse Alto brand. Smoore International has been informed by RJR that the temporary administrative stay for the marketing denial orders has been approved, allowing the marketing and distribution of menthol-flavored products to continue in the U.S.

Smoore noted that the board is aware that the FDA issued marketing denial orders (MDOs) to R.J. Reynolds Vapor Company (RJR) for six menthol-flavored and mixed berry-flavored e-cigarette products under the Vuse Alto brand on October 12, 2023. The group supplies menthol-flavored products to RJR, which accounted for approximately 13% of the group's revenue from January 1, 2022, to September 30, 2023. 

Smoore stated that the board further noted that RJR indicated on the same day its intention to challenge the MDOs and seek a stay of enforcement. The company has also been informed by RJR that the temporary administrative stay for the MDOs has been approved, allowing the marketing and distribution of menthol-flavored products to continue in the U.S. If the stay is granted, menthol-flavored products can continue to be marketed and distributed in the U.S. If RJR fails to obtain the stay and the temporary administrative stay expires or is revoked, or if the MDOs are ultimately upheld, menthol-flavored products may not be allowed to be marketed and distributed in the U.S. 

Smoore stated that the company will closely monitor the situation and make further announcements as necessary.
