Guidelines on Promoting the Construction of a Quality Assurance System for Export E-Cigarette Products

Article 1? In order to promote the legalization and standardization of the development of the e-cigarette industry, effectively prevent the risks of the export e-cigarette trade, and promote e-cigarette related production enterprises (hereinafter referred to as enterprises) to actively build a quality assurance system for export e-cigarette products, in accordance with the Tobacco Monopoly Law of the People's Republic of China,"Regulations on the Implementation of the Tobacco Monopoly Law of the People's Republic of China" and "Measures for the Management of Electronic Cigarettes"(Announcement No. 1 of 2022 of the State Tobacco Monopoly Administration) and other laws, regulations, rules and normative documents.

Rule 2? The construction of the quality assurance system for export e-cigarette products must be guided by Xi Jinping Thought on Socialism with China Characteristics for a New Era, and adhere to the principles of safety first, prevention first, risk management and control throughout the process. Based on the actual situation of the enterprise, we will actively align with international advanced technologies, rules and standards, strive to improve product quality, strive to ensure product safety, and comprehensively improve the overall level of quality and safety of exported e-cigarette products.

Rule 3? The enterprise is fully responsible for the quality and safety of the export e-cigarette products it produces and operates, carries out production and operation activities in accordance with laws and regulations, and accepts supervision and management.

Article 4? Enterprises shall ensure that their export products comply with the laws, regulations and standard requirements of the destination country (region); if the destination country (region) does not have relevant laws, regulations and standard requirements, they shall comply with the relevant requirements of China's laws, regulations and standards.

Article 5? Enterprises should establish a quality assurance management system that includes all elements, entire processes, and all data to ensure the effective operation of the system and ensure that the procurement of export e-cigarette raw materials, product production, storage, and transportation processes continue to comply with relevant laws, regulations and quality and safety requirements. Encourage enterprises with mature conditions to participate in relevant quality system qualification certification.

Article 6? Enterprises should clarify the quality and safety standards for exported e-cigarette products, formulate testing operating procedures for raw and auxiliary materials, semi-finished products, and finished products, implement quality and safety testing, and form test reports or certificates.

Article 7? Enterprises should systematically sort out their processes to ensure that they can continuously and stably produce products that meet the quality and safety standards defined by the enterprise, strengthen business operation training, and ensure that staff can operate correctly in accordance with the process.

Article 8? Enterprises should ensure that the production resources equipped for self-production or entrusted processing meet relevant requirements, including:

1. Personnel with appropriate qualifications and training;

2. Safe buildings and spaces;

3. Applicable equipment and maintenance guarantees;

4. Qualified raw, auxiliary and packaging materials;

5. Qualified storage and transportation conditions;

6. Other necessary production resources.

Article 9? Enterprises should establish a supplier evaluation system, an incoming inspection record system, a production record archive system, a factory inspection record system, an inspection record system for entrusted processed products, a product traceability system and a system for disposal of unqualified products. Relevant records should be true and effective, and the storage period should not be less than 6 months after the expiration of the product shelf life.# p#pagination title #e#

Rule 10? The boxes and box packages of exported e-cigarette products should be marked with the license number of the tobacco monopoly production enterprise, product name, production batch number and production date. Among them, the boxes and packaging of exported e-cigarette products entrusted for processing should be marked with the tobacco monopoly production enterprise license number of the entrusted e-cigarette production enterprise.

Article 11? The domestic and international logistics and transportation of exported e-cigarette products should comply with relevant safety requirements to ensure full traceability.

Article 12? When exporting e-cigarette products, enterprises should truthfully declare to the customs in accordance with the law, and should file relevant information on the national unified e-cigarette trading management platform within 30 days after export declaration.

Article 13? If exported e-cigarette products have quality and safety problems that have caused or may cause damage to human health, the enterprise shall immediately stop the production of relevant products, take corresponding measures to avoid and reduce the occurrence of damage, and report to the local Tobacco Monopoly Bureau.

Article 14? If exported e-cigarette products are notified by international organizations or overseas government agencies due to quality and safety issues, the enterprise shall immediately report to the local Tobacco Monopoly Bureau, and the relevant enterprise shall accept the verification and handling organized by the Tobacco Monopoly Bureau in accordance with the law.

Article 15? The State Tobacco Monopoly Administration will build a quality traceability system for exported e-cigarette products, improve enterprise quality and safety credit supervision, and realize informatization, networking and intelligence of quality and safety supervision of exported e-cigarette products. Tobacco monopoly bureaus at all levels should coordinate with customs, market supervision, taxation and other departments to strengthen joint supervision.

Article 16? Export e-cigarette products refer to e-cigarette products produced by enterprises that are not sold in China and are only used for export. Refer to these guidelines for the construction of quality assurance systems for nicotine and aerosolized substances for export of electronic cigarettes.

Article 17? The State Tobacco Monopoly Administration is responsible for interpreting these guidelines.

Article 18? These Guidelines will come into effect as of the date of promulgation.
