Regulatory policies have a huge impact on any industry, especially the electronic atomization sector. Because of the unique nature of its products, it is particularly sensitive to regulatory policy.

There are already strong real-world examples, both positive and negative, showing how different regulatory approaches affect the vaping industry.

On one hand is the UK, which has taken a positive approach toward vaping products. For a long time, it has actively promoted e-cigarettes as an effective harm-reduction tool to help the public reduce the damage caused by tobacco. It has also demonstrated the practical public health value of vaping products through concrete action, including bringing them into the healthcare system and even providing them free of charge to low-income groups. This supportive attitude and these measures have also led to a significant drop in the UK smoking rate, repeatedly setting new historic lows.By contrast, the United States, the world’s largest consumer market for vaping products, accounts for more than 50% of global consumption, yet its negative regulatory stance has caused the U.S. vaping industry to shrink dramatically and has even become a “disaster” for the sector. The Premarket Tobacco Product Application (PMTA) process established by the U.S. Food and Drug Administration (FDA) is the strictest e-cigarette regulation to date. For most small and medium-sized businesses, it is essentially an impossible task. Many vaping-related companies have shut down, and even Avail Vapor, a major U.S.-based vaping company founded in 2013, has not been spared, having to gradually scale back its operations and branches to cope with this regulatory “disaster.”

AVAIL Vapor LLC is one of the larger e-cigarette retailers in the United States. It was originally founded by James Xu in 2013. Its business includes not only physical retail stores but also significant success in online sales. It has since grown to more than 100 retail outlets across 12 U.S. states, established a manufacturing plant in Chesterfield County, and employs more than 400 people.

However, under the current extremely harsh regulatory environment, the brand has basically been stuck in a state of “zero” business since entering 2022. As a result, founder James Xu decided to “exit the market.”

James Xu believes that, like other e-cigarette companies, AVAIL Vapor cannot meet the FDA’s overly stringent regulatory requirements and therefore cannot legally and compliantly conduct normal business operations in this environment. At first, he still held out a glimmer of hope that the FDA would eventually regulate the market with common sense, but that hope has now been shattered. The FDA’s regulatory approach has made it impossible for AVAIL Vapor to continue operating normally, leaving it facing closure.

This sentiment is widespread across the entire U.S. vaping industry. Information gathered from various channels shows that although the FDA has already rejected thousands of Premarket Tobacco Product Applications (PMTAs) from small and medium-sized businesses, millions more applications remain backlogged and are still awaiting FDA action. However, the FDA has not truly reviewed these applications. Instead, it has created a new method for handling the millions of backlogged PMTAs so they can be rejected quickly, rather than being individually assessed in detail. This fast-track approach to clearing the backlog has essentially sealed the fate of these companies, leaving them no option but to shut down.

This shows that both a lack of regulation and excessive regulation can have a major impact on the development of the industry, while appropriate regulation can promote its healthy growth.
