According to the website of the State Council's Legislative Affairs Office, on November 24, the National Health and Family Planning Commission recently drafted the "Regulations on Smoking Control in Public Places (Draft for Review)" (hereinafter referred to as the draft), which is open for public comments. The draft clearly prohibits all tobacco advertisements, promotions, and sponsorships.

The draft requires a complete ban on smoking in all indoor public places. Additionally, smoking is also completely prohibited in outdoor spectator seating and competition areas of sports and fitness venues, as well as outdoor waiting areas of public transportation.

The draft stipulates that outdoor areas of certain public places such as scenic spots, cultural heritage sites, parks, and amusement parks can set up designated smoking areas, while smoking is prohibited outside these areas. Outdoor areas of public places without designated smoking areas are considered completely smoke-free.

The draft clearly states that operators and managers of smoke-free places (areas) must not place smoking devices or set up tobacco advertisements in these areas. They are required to discourage illegal smoking behavior and ask those who refuse to comply to leave. For those who continue to refuse to comply and disrupt public order, reports should be made to the relevant supervisory authorities; for those who continue to refuse and disturb public order, reports should be made to the public security organs.

Analysis suggests that electronic cigarettes are more in line with health and environmental trends and are expected to usher in development opportunities. Shenwan Hongyuan pointed out that one of the reasons for the rapid growth of the electronic cigarette industry abroad is the strict smoking bans. Smoking bans in public places primarily focus on public health and safety. Against this backdrop, electronic cigarettes are expected to welcome development opportunities. Since electronic cigarettes do not contain harmful substances such as tar, carbon monoxide, arsenic, lead, and mercury found in traditional cigarettes, their toxicity is only one-thousandth that of regular cigarettes; they do not produce secondhand smoke pollution, making them healthier and more environmentally friendly than traditional cigarettes. At the same time, domestic tobacco companies, facing potential development bottlenecks in traditional cigarettes, are also expected to prioritize the development of electronic cigarettes as an effective supplement for future revenue and profits.
