According to reports, this was a class-action lawsuit initiated by investors. They argued that before its public stock offering, the vaping distributor should have disclosed an important piece of information to investors: that the United States was planning to implement vaping-related restrictions.

However, in ruling on the class-action case, the district court judge stated that the distributor of Juul Labs vaping products had no obligation to disclose, prior to its initial public offering, a proposed vaping ban that was under consideration at the time. In fact, the vaping company had already warned in its investment statement that investors should be aware of the risks of government regulation of the tobacco industry.
