Nova Scotia High Court Upholds Provincial Vaping Regulations

Last May, Nova Scotia approved regulations limiting the nicotine content of e-cigarette products to 20mg/ml, making it the first province in Canada to implement such vaping regulations. This was part of an amendment that took effect on April 1, which banned various fruit-flavored e-cigarettes.<\/span><\/div>

The province also approved a tax on e-cigarette products, which took effect on September 15. Additionally, it will become one of the first regions in Canada to require a sales license for selling these products, although this legislation has been delayed due to the pandemic.<\/span><\/div>

An article in Global News revealed that MacEachern, who identified himself as a long-time smoker, was able to quit smoking by using e-cigarette products and felt much better within weeks of switching. He questioned the constitutionality of the province's restrictions, arguing that they infringed on his right to personal safety (as outlined in Section 7 of the Charter of Rights and Freedoms) and sought to suspend these measures.<\/span><\/div>

However, the designated judge ruled that MacEachern failed to demonstrate that he would suffer irreparable harm if the injunction was not granted, adding that he had not proven that lifting these measures would benefit public health.<\/span><\/div>

The Canadian Vaping Association (CVA) had previously warned the Nova Scotia government that banning flavored vaping products could backfire, pushing vaping products into the black market and potentially causing former smokers to revert to traditional cigarettes.<\/span><\/div>
