California Vote Supports Repealing the Fruit Flavor Ban

According to the Associated Press, a referendum overturned California's Friday ban on approved fruit-flavored tobacco products. Voters will decide in November 2022 whether to uphold the ban. The law would not take effect until after the voters' decision.

The ban restricts the sale of flavored products but does not criminalize the possession of these products. Exceptions are made for premium cigars and water pipe tobacco. The ban includes, but is not limited to, flavorings such as "fruit, chocolate, vanilla, honey, candy, cocoa, desserts, alcoholic beverages, menthol, mint, wintergreen, vanilla, or spices." Those found selling prohibited products will face a $250 fine.
 
Supporters of the law argue that these products target young people, particularly in Latino and Black communities, while opponents of the ban argue that it goes too far, taking away products favored by some users while allowing the continued sale of products preferred by wealthier communities.
 
Former state senator Jerry Hill introduced the legislation. He stated that his goal is to target products that lead to youth addiction, claiming that tobacco companies are trying to "delay the inevitable."
