FDA Warns Vape Retailers Selling Unauthorized Products

In the first week of January, the FDA released the long-awaited guidelines regarding flavored vaping products. These guidelines took effect in February of last year.<\/span><\/div>

As a result, the agency began receiving reports about non-compliant businesses. On April 22, warning letters were sent to companies, including online retailers and retail stores such as gas stations and convenience stores, requesting a response within 15 days.<\/span><\/div>
Additionally, the FDA recently sent ten warning letters to retailers and manufacturers who have been selling and/or importing unauthorized e-cigarette products and related items aimed at young people. These items include backpacks and sweatshirts designed with hidden pockets specifically for concealing e-cigarettes.<\/span><\/div>

Warnings were also issued to businesses selling e-liquids that mimic candy packaging or feature cartoon characters like SpongeBob aimed at young audiences. Here are some of the companies that received warning letters:<\/span><\/div>

Manufacturing products that make it easier for youth to hide vapes is unacceptable.<\/span><\/div>
Of course, together with harm reduction advocates, we condemn the production and sale of any products that make it easier for youth to hide and use e-cigarette products, and agree with the FDA's statement that this is unacceptable. "The FDA focuses on manufacturers and retailers that produce and sell ENDS products aimed at youth and enhance their appeal. The public should really be outraged by these products," said JD Mitch Zeller, director of the FDA's Center for Tobacco Products.<\/span><\/div>

The FDA is concerned about the sale of these new products to children and adolescents, as they facilitate the concealment of product use, thus attracting kids, as it allows them to hide from parents, teachers, law enforcement, or other adults."<\/span><\/div>

"Even during the COVID-19 pandemic, we have not lost focus on protecting youth from the harms of e-cigarettes and will take action to the best of our ability. These warning letters should send a clear message to all tobacco product manufacturers and retailers that the FDA will closely monitor the market. If you are marketing or selling these products to youth, the FDA will not tolerate it." Zeller added.<\/span><\/div>
