U.S. Fruit-Flavored E-Cigarette Ban Draws Fire from Both Supporters and Opponents

As the U.S. fruit-flavored vaping product ban takes effect, both industry and anti-vaping advocates are criticizing it. FDA guidance warns companies that keep selling unauthorized flavored cartridge products after 30 days could face enforcement.
According to vapingpost, as the fruit flavor ban in the U.S. takes effect, both the e-cigarette industry and anti-vaping advocates are criticizing it. Last month, the FDA released the long-awaited guidelines regarding flavored e-cigarette products.

The guidelines state that companies that do not stop the production, distribution, and sale of unauthorized flavored cartridge e-cigarettes (excluding tobacco or menthol) within 30 days may face enforcement actions from the FDA.

The ban applies to e-cigarettes with flavors other than tobacco and menthol, as well as products aimed at minors. The ban on e-cigarettes has not greatly angered anti-vaping advocates, who claim it will only lead young people to switch products.

On the other hand, the e-cigarette industry has pointed out that banning flavors is not the solution, as smokers are trying to use these devices to quit smoking.

Meanwhile, several states in the U.S. have enacted their own versions of flavor bans. A bill in New Jersey proposing a ban on the sale of flavored e-cigarette products has passed in both the Senate and the state assembly. Similarly, California lawmakers have introduced a bill that would ban all flavors, including menthol.

On the other hand, in New York, a Supreme Court judge issued an injunction against Governor Cuomo's ban on flavors. While the Michigan Supreme Court rejected Governor Gretchen Whitmer's request, it lifted a lower court's injunction against her ban on flavored e-cigarette products.
