· Case Information

On October 8, 2023, a cross-provincial illegal operation involving vaping devices was successfully cracked by the police in Liaocheng, Shandong.

It has been determined that from October 2021 to the present, the suspect Zhang, knowing that he did not have the qualification for tobacco monopoly licensing, repeatedly sold non-standard vaping devices online, with sales amounting to over 300,000 yuan.

Safety Warning

Due to the mixed quality of non-standard vaping products, production lacks regulation, and certain substances may exceed national standard limits, potentially producing carcinogens such as formaldehyde, acetaldehyde, and nitrosamines when heated, long-term use may harm health.

Legal Consequences

According to the mandatory national standards for vaping devices issued on October 1, 2022, the national unified trading management platform for vaping devices only provides standard tobacco-flavored vaping devices and prohibits the sale of non-standard vaping devices; otherwise, it may violate Article 140 of the Criminal Law of the People's Republic of China, “producing and selling inferior products,” which carries a maximum penalty of 15 years in prison or life imprisonment. Article 225, “illegal business operations,” carries a maximum penalty of over 5 years in prison, among others.
