Implementation Rules for E-cigarette Product Packaging

Article 1 These detailed rules are formulated to standardize the packaging of e-cigarette products sold within the territory of the People's Republic of China and to protect consumer rights and interests, in accordance with the Tobacco Monopoly Law of the People's Republic of China, the Implementing Regulations of the Tobacco Monopoly Law of the People's Republic of China, the Administrative Measures for Electronic Cigarettes (State Tobacco Monopoly Administration Announcement No. 1 of 2022), and other relevant laws, regulations, rules, and normative documents.

Article 2 For the purposes of these detailed rules, e-cigarette products include pods, devices, disposable e-cigarettes, and e-cigarette products sold within one packaging unit in accordance with relevant national standards (hereinafter referred to as "kits").

Article 3 The basic units of measurement for counting e-cigarette pods, devices, disposable e-cigarettes, and kits shall be "unit," "ten thousand units," and "one hundred million units."

Article 4 The smallest packaging unit for e-cigarette products in the retail and wholesale stages shall be a box, and the smallest packaging unit at the factory stage shall be a carton. Different products are prohibited from sharing the same packaging unit, and the pods contained in a kit shall be of the same product. A single box of pods shall contain 1-3 pods; a single box of devices shall contain 1 device; a single box of disposable e-cigarettes shall contain 1 disposable e-cigarette; and a single boxed kit shall contain 1 device and 1-3 pods. Cartons of pods and disposable e-cigarettes shall use one of three packaging specifications: 50 boxes, 100 boxes, or 200 boxes per carton. Cartons of devices and kits shall use one of three packaging specifications: 20 boxes, 50 boxes, or 100 boxes per carton.

Article 5 Box and carton packaging for e-cigarette products shall bear a QR code label uniformly prescribed by the tobacco monopoly administrative department under the State Council.

Article 6 In addition to warning statements, registered trademarks, nicotine content, and wording required by the tobacco monopoly administrative department under the State Council, as well as other information required to be labeled under relevant national laws and regulations and the mandatory national standards for e-cigarettes, box packaging for e-cigarette products shall also indicate the product name, production date and expiration date, quantity and specifications of the contents, battery capacity (if any), customer service phone number, and other information. Carton packaging shall indicate product information, company information, quantity and specifications of the contents, carton dimensions (length × width × height), and other information.

Article 7 Imported e-cigarette products shall be marked with the words "For sale in mainland China only" on both box and carton packaging. Box and carton packaging for exported e-cigarette products shall comply with the relevant requirements of the destination country or region and shall indicate the tobacco monopoly production enterprise license number.

Article 8 Packaging specifications for other forms of e-cigarette products shall be separately prescribed.

Article 9 These detailed rules shall be interpreted by the tobacco monopoly administrative department under the State Council.

Article 10 These detailed rules shall come into force on the date of promulgation.
