1. Scope of application

2. Basis for handling

2. Article 5 of the "Measures for the Management of Electronic Cigarettes" E-cigarette products shall comply with the mandatory national standards for e-cigarettes. Article 7 The tobacco monopoly administrative department of the State Council shall organize professional institutions to conduct technical review of e-cigarette products based on application materials such as inspection and testing reports. Article 19 E-cigarette products that have not passed the technical review shall not be sold on the market. Electronic cigarette products on the market should be consistent with product information that has passed technical review. Article 29 Imported e-cigarette products sold in China shall pass technical review and use trademarks approved and registered in China. Article 33 E-cigarette products that are not sold in China but are only used for export shall comply with the laws, regulations and standards of the destination country or region; if the destination country or region does not have relevant laws, regulations and standards, they shall comply with relevant requirements of our country's laws, regulations and standards.

5. Application conditions
(1) Applicant Conditions
1. Have corporate legal personality;
2. Is the trademark owner of the e-cigarette product under application;
3. Comply with national e-cigarette industry policy requirements;
4. Other conditions stipulated by the tobacco monopoly administrative department of the State Council.
If the trademark owner is an overseas enterprise, it shall entrust the institution or agent established in China to apply to the local provincial tobacco monopoly administrative department.
When applying for an overseas trademark owner, it shall comply with paragraph 1 of the preceding paragraphConditions 1, 3 and 4.
(2) Product application conditions
1. Comply with mandatory national standards for e-cigarettes;
2. Use trademarks approved and registered in China;
3. Comply with relevant regulations on e-cigarette product packaging logos and warnings;
4. Other conditions stipulated by the tobacco monopoly administrative department of the State Council.
E-cigarette products sold in a packaging unit that containthe cartridgeand supporting smoking equipment should be products that have passed technical review.
6. Application Materials
(1) Domestic sales of e-cigarette products
To apply for technical review of e-cigarette products sold in China, the following information shall be submitted through the management system:
1. Basic information of the product;
2. Trademark Registering Certificate of the product;
3. Product packaging and appearance pictures;
4. A sample manual is attached to the product;
5. Product description report;
6. Product formula and raw material report;
7. Description of key production processes related to safety;
8. Product inspection and testing reports and other necessary inspection and testing reports;
9. Product safety assessment or demonstration report;
10. The applicant's letter of commitment on the legality, authenticity and integrity of the submitted materials;
11. Other relevant information.
For e-cigarette products sold in a packaging unit, the cigarette cartridges and supporting smoking equipment must have passed the technical review, and only the provisions specified in the preceding paragraph must be submitted.1 to 4 items of information.
In addition to the materials specified in the preceding paragraph, imported e-cigarette products must also provide certification materials for approved production or sales in the country (region) where they are located.
After receiving the application, the provincial tobacco monopoly administrative department organizes and completes the online review of the materials, and issues a mail notice for paper materials and physical samples if they meet the requirements; Those that do not meet the requirements will not be accepted.
After receiving the mailed notice, the applicant shall submit technical review paper materials and physical samples consistent with the application materials to the provincial tobacco monopoly administrative department. The technical review agency is responsible for reviewing the application materials and informing the applicant of the content that needs to be corrected if necessary， Applicants should follow Requirements Complete correction.
(2) Supplementary explanation
1. Product technical review application has“ Add new products” and“ Add existing series of products” two entrances. Series products refer to the same type of products with different product and packaging appearance, or different number of products in the boxed unit, and completely consistent other characteristic parameters. 2. When applying for a new cigarette bomb or smoking equipment product, you need to fill in the product that matches it. Adapt products can choose from proprietary products or non-proprietary products. If the adapted product is your own product and the application materials have been completely filled in and saved, you can directly check the product item in the adapted product list. If the adapted product is also a new product to be applied for, you need to follow the steps to fill in all application materials for the adapted product and save them, and then continue to complete the remaining application materials for the main product. When selecting a non-owned product as an adapted product, you also need to upload the authorization letter that the product is licensed to adapt.
3. To apply for technical review for an overseas trademark owner, an authorization agreement signed by both parties must be provided (including the name of the e-cigarette product entrusted by the overseas trademark owner to an institution or agent established in China to handle technical review and the authorization time limit, etc.).
4. If the product design (including appearance, structure, formula, raw materials, etc.) changes, you need to log in to the management system again to apply.

7. Reporting requirements
1. Applicants should fill in and report various application materials in a standardized and complete manner in accordance with the requirements of the management system filling instructions and information prompts;
2. The applicant's name, address, legal representative and other contents filled in the application materials shall be consistent with the applicant's main account registration information (except for agency applications). The same contents in the application materials shall be filled in consistently, and the official seal or seal affixed shall be consistent with the corresponding entity;
3. The attached data uploaded should be clear and easy to identify, and consistent with the original;
4. Paper materials and physical samples mailed offline should be consistent with the materials submitted online;
5. The application information and attachments, etc. in the application materials, should be in standardized Chinese, unless it is necessary to use a foreign language;
6. The applicant shall truthfully provide relevant information and materials to the management department, and be responsible for the legality, authenticity and integrity of the application materials.
8. Application time

10. Technical review
(1) Review agency
The technical review work shall be carried out by professional institutions organized by the tobacco monopoly administrative department of the State Council (hereinafter referred to as technical review institutions).
(2) Review content
1. Integrity and rationality of product description, formula and raw material report;
2. Effectiveness and applicability of relevant inspection and test reports;
3. The scientificity, reliability and sufficiency of product safety assessment and demonstration;
4. Rationality, feasibility and controllability of product quality and safety assurance;
5. Consistency of product flavor;
6. Other content that requires technical review.
XI. Processing time limit

The time required for review inspection, on-site verification, and supplementary evidence materials is not counted into the review time limit.
12. Processing results
The tobacco monopoly administrative department of the State Council will incorporate products that have passed the technical review into the national unified e-cigarette transaction management platform, regularly publish and implement dynamic management.
From the date of application submission, applicants can check the status and results of application processing through the management system.
XIII. Prohibited requirements
Under the following circumstances, the tobacco monopoly administrative department may refuse to accept the application for technical review:
1. Not within the scope of technical review of e-cigarette products;
2. Submit duplicate or erroneous applications;
3. The applicant has been unable to be contacted for more than five working days through the application information;
4. Correction does not meet the requirements;
5. Belonging to Article 21 of the Implementation Rules for the Technical Review of Electronic Cigarette Products;
6. Other inadmissibility circumstances stipulated by the tobacco monopoly administrative department.
14. Registration requirements
Before products that have passed the technical review are included in the national unified e-cigarette trading management platform, product registration shall be completed with the provincial tobacco monopoly administrative department.
15. Charging basis and standard
There is no charge.
