On September 18, Brian King, the new director of the Center for Tobacco Products (CTP) at the U.S. Food and Drug Administration (FDA), declined to disclose whether the agency is willing to remove unauthorized vaping products from the market during an interview with Politico.<\/span><\/div>

Currently, the FBI is seeking a court order, threatening to file a lawsuit to demand the destruction of unauthorized products. Filter has confirmed that the FDA notified the Department of Justice (DOJ) before September 1 that at least two open-system vaping companies violated the Federal Food, Drug, and Cosmetic Act (FDCA) because the manufacturers did not submit premarket tobacco product applications (PMTAs) and continued to sell their products.<\/span><\/div>

It is noteworthy that the FDA has announced it has accepted over 350 PMTAs for NTN products (non-nicotine), with nearly 1 million applications submitted.<\/span><\/div>
