What are the projected trends in domestic e-cigarette regulation?
As e-cigarettes have not yet been incorporated into the existing regulatory framework for tobacco products at the national level, their production and distribution are still largely operating in a regulatory gray area. The “Announcement No. 1” has, to some extent, filled gaps in the regulation of online sales and advertising of e-cigarettes, but its effectiveness remains to be seen.

The risks created by this regulatory gap are reflected not only in the potential health risks associated with using e-cigarettes themselves, but also in the product quality risks arising from a market with widely varying standards.
As the world’s largest producer and exporter of e-cigarettes, China should accelerate legislative efforts at the national level and introduce relevant laws and regulations as soon as possible to ensure comprehensive and effective oversight of e-cigarettes, or enact dedicated legislation to eliminate the current lack of a legal basis for regulation.
It is foreseeable that national standards for e-cigarettes will be issued soon, and bringing e-cigarettes into the strict regulatory system for tobacco products is also an inevitable trend.
All types of market participants in the e-cigarette sector, including manufacturers and distributors, should closely monitor regulatory developments and take timely and effective response measures to avoid both commercial and legal compliance risks.
