On January 28, the "Shenzhen Special Economic Zone Smoking Control Regulations (Revised Draft for Public Consultation)" was publicly solicited for opinions on the website of the Municipal People's Congress Standing Committee. The new Shenzhen "Smoking Control Ordinance" includes "e-cigarettes" in the smoking control scope, sparking widespread discussion in society.

On February 22, the legislative opinion meeting for the "Shenzhen Special Economic Zone Smoking Control Regulations (Amendment Draft for Public Consultation)" was held at the Citizen Center. The Secretariat of the Electronic Cigarette Industry Committee of the China Electronic Commerce Association was invited to participate by the Education, Culture, Health, and Sports Work Committee of the Shenzhen Municipal People's Congress Standing Committee.

Attendees included leaders from the Education, Culture, Health, and Sports Work Committee of the Municipal People's Congress Standing Committee, the Municipal Market Supervision Administration, the Municipal Health Commission, as well as representatives from electronic cigarette companies including the vice president unit of the Electronic Cigarette Industry Committee of the China Electronic Commerce Association, Bodi Technology Company, and electronic cigarette distributors. The Education, Culture, Health, and Sports Work Committee of the Municipal People's Congress Standing Committee and the Municipal Health Commission supported including e-cigarettes in the smoking control regulations, while the Municipal Market Supervision Administration and the Electronic Cigarette Industry Committee of the China Electronic Commerce Association hoped to consider various interests and suggested not to adopt a one-size-fits-all approach.

Director Chen of the Education, Culture, Health, and Sports Work Committee of the Municipal People's Congress Standing Committee stated: "As people's health awareness increases, smoking control efforts should be strengthened. We plan to revise the smoking control regulations through the People's Congress to include e-cigarettes in the same smoking control regulations as traditional cigarettes." The Municipal Health Commission believes: From a health perspective, it does not want to see young people take pride in smoking e-cigarettes and suggests formulating policies based on strict and practical principles.

Secretary General Ao Weinuo of the Electronic Cigarette Industry Committee of the China Electronic Commerce Association expressed the industry's views from four aspects.

1. E-cigarettes were invented by the Chinese, and e-cigarettes produced in Shenzhen occupy over 90% of the global market, primarily exporting to the United States and Europe. This is a sunrise industry with a global layout, contributing to foreign exchange earnings and providing employment opportunities. Currently, it occupies a very small market share in our country, and we should view this emerging industry with an objective, scientific, and rational attitude;

2. E-cigarettes are heating and atomizing devices that do not produce open flames, thus posing no fire hazard. The secondhand smoke they produce has minimal environmental pollution and harm to human health, and should be classified and distinguished, requiring further research and assessment;

3. Understanding the inclusion of e-cigarettes in the smoking control regulations for public places and public transportation; supporting the prohibition of sales to minors under 18 years old;

4. Suggesting to relax the scope and enforcement of smoking control regulations for e-cigarettes during the legislative revision of the smoking control regulations, categorizing smoking control venues. Director Cui of the Market Supervision Administration believes: Shenzhen is a global e-cigarette manufacturing base, primarily focused on exports. Regarding domestic regulatory policies, it is suggested that smoking devices should be managed as ordinary consumer goods, and e-liquids containing nicotine and those without should be classified. The regulatory measures for e-liquids require comprehensive research and assessment, and the export-oriented e-cigarette industry should be supported. The industry should accelerate standardization and promote healthy and sustainable development.

In addition, Director Li of the Market Supervision Administration supplemented information about the number of companies engaged in the e-cigarette industry in Shenzhen, the number of employees, the scale of industry exports, the number of patents, and other data, suggesting a multi-faceted evaluation of the e-cigarette industry, balancing various factors.
