The amendment fills a regulatory gap that previously existed. According to the Serbian Ministry of Trade, the law did not define electronic cigarettes or prohibit sales to minors.

The ministry believes that electronic nicotine delivery systems pose serious health risks, encourage nicotine addiction, and expose users to carcinogens. According to the ministry, they also increase the likelihood of individuals starting to use other tobacco products (such as cigarettes).

"All studies conducted conclude that by vaping electronic cigarettes, whether or not filled with nicotine, not only vapor is released into the air, but also some chemicals. The harmful effects of these products are reflected in personal health and are concentrated in all components of the environment," it stated.

The amended law prohibits the sale, service, and gifting of electronic cigarettes containing or not containing nicotine to individuals under 18 years of age, as well as the sale of such products by individuals under 18 years of age.
