Although Brazil's legislative council has continually postponed the final decision on regulations for safer tobacco alternatives, a new proposal has been introduced to strengthen the nationwide ban on heated tobacco (HnB).

The legal proposal will prohibit "the production, import, sale, and promotion of electronic smoking devices, including e-cigarettes and heated tobacco products and their accessories," and is currently under review in the House of Representatives.

The proposal was introduced by Eduardo Costa, a congressman from Brazil's minority Labor Party (PTB), in November 2020, and he hopes that violators will face penalties as stipulated in Brazilian health legislation, ranging from fines to business closures. The proposal was received by the Committee on Economic, Industry, Trade, and Services last month, nearly four months after its initial introduction.
