US Judge Questions FDA Inaction, Orders Faster Vape Review

According to the Associated Press, a U.S. federal judge has ordered the FDA (Food and Drug Administration) to review thousands of e-cigarettes on the U.S. market. The court believes that the FDA has failed to regulate e-cigarettes in a timely manner, neglecting its legal responsibilities.

Currently, there is little research focusing on the long-term health effects of e-cigarettes, and it is unclear whether they help with smoking cessation.

Organizations like the American Academy of Pediatrics believe that the FDA's lack of regulation has led to the rampant use of e-cigarettes among teenagers, with nicotine addiction threatening the health of a generation.

The U.S. is indeed very unfriendly towards e-cigarettes. Recently, a proposal was made by a Chinese hospital aimed at destroying the e-cigarette industry. If passed, this proposal would ban various e-liquid flavors and online sales, and raise the minimum age for purchasing e-cigarette products to 21. This proposal would also authorize the FDA to collect $100 million from the industry as a usage fee. It demands the prohibition of all “unique flavors” other than tobacco flavors unless approved by the FDA; bans online sales; authorizes the FDA to charge a $100 million usage fee from the e-cigarette industry; prohibits sales to anyone under 21; orders the FDA to issue standards and regulations regarding the use of synthetic nicotine products; and extends all rules regarding cigarette sales and marketing to e-cigarette products, including restrictions on advertising.

In addition, the FDA has stated that their regulators are investigating the potential link between e-cigarette use and seizures, which has had some negative impacts on the e-cigarette industry in the U.S.

Currently, the U.S. has also increased tariffs on the e-cigarette industry, with the aim of “taxing products imported from other countries to enhance the competitiveness of American products and create domestic economic value.” However, in an industry where almost all products are manufactured in China, there is no American manufacturing sector that can address the current issues faced by the e-cigarette industry.

Since the U.S. lacks a large number of e-cigarette product manufacturers, this tax will only lead to the survival of American importers being jeopardized, consumers facing reduced product availability or delays in purchasing, retailers struggling, and distributors and importers buying fewer products from Chinese companies, leading to cuts in R&D budgets and layoffs in Shenzhen factories, ultimately punishing only the American players in the e-cigarette market. It is evident that the days of calm in the e-cigarette industry are over.
